Settlement agreements

If your employer has offered you a settlement agreement, our expert solicitors can act for you.

It is a legal requirement that you obtain legal advice on the terms and effect of any settlement agreement and in particular its effect on your ability to pursue claims before the Employment Tribunal. By signing an agreement, you waive your rights to pursue certain claims, hence the necessity to obtain independent advice.

Our solicitors have considerable experience in assessing severance packages by evaluating the offer against any potential claims that you may have and likely damages.  In some cases it may be appropriate to negotiate a higher termination payment or compensation payment on your behalf with your employer. We have the expertise to ensure that you secure the best deal possible. Even when you have no possible claims against your employer, your employer may still be willing to increase their offer.

There could be other terms to negotiate on. For example, you might still be bound by restrictive covenants in your employment contract. Sometimes employers are willing to waive certain restrictions, such as a non-compete restriction, or reduce the length of the restrictions. We’ll make sure that your restrictive covenants are dealt with, when relevant.

We will also examine other issues that might not be immediately obvious. You might have a bonus, possibly deferred, which should be covered off in the agreement or require a reference to be agreed and annexed. Agreeing an internal and external announcement could also be appropriate and depending on your circumstances, there might be other matters to raise such as relating to confidentiality, notice, gardening leave and accrued holiday.
