Discrimination

If you believe that you have been discriminated against at work, our employment solicitors can advise you on your rights and help you take the most appropriate action.

Discrimination in the workplace can be deeply hurtful, with life-changing consequences. It can be overt or subtle and it can come from any direction, including employers, colleagues, or even clients. Our solicitors will help you establish whether discrimination has happened and guide you through the process of dealing with it.

Your employer must do all that they can to ensure that your employment is free of discrimination based on the following protected characteristics:

  • age
  • gender and reassignment
  • pregnancy and maternity leave
  • race including colour, nationality, ethnic origin
  • marriage and civil partnership
  • sex
  • sexual orientation
  • disability
  • religion or belief

The different types of discrimination prohibited by our equality legislation include:

  • direct discrimination, where you are treated less favourably because of a protected characteristic
  • indirect discrimination, where a provision, criterion or practice is applied which disadvantages your race (or sex etc) without objective justification and you are personally disadvantaged
  • harassment, where a person engages in unwanted conduct related to race (or sex etc) which has the purpose or effect of violating your dignity or creates an intimidating, hostile, degrading, humiliating or offensive environment for you
  • victimisation, where you suffer a detriment because you have alleged discrimination, brought a discrimination claim or given information or evidence in relation to proceeding

Disability Discrimination

If you have a physical or mental impairment which has a substantial and long-term adverse effect on your ability to carry out normal day-to-day activities, your employer must not discriminate against you.

Our solicitors can advise you on the types of disability discrimination prohibited by our equality legislation including failing to comply with the duty to make reasonable adjustments where a disabled person is placed at a substantial advantage. We’ll help you establish your rights and advise you on the course of action that is in your best interests.

Whatever type of discrimination complaint you have, we are here to help you find a solution. Please do not hesitate to get in touch.
